TrailBound Terms of Service

These Terms of Service ("Terms") are an agreement between you and Josh Sharrer, doing business as TrailBound, United States ("TrailBound", "we", "us"). They govern your use of the TrailBound mobile app and website (the "Service"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use TrailBound. If you are under 18 you may only use the Service with the consent of a parent or guardian, who agrees to these Terms on your behalf. By using the Service you confirm that you meet these requirements and that you are not barred from using it under any applicable law.
2. Your account
You need an account to use the Service. You agree to provide accurate information, keep your password secure, and tell us promptly at support@trail-bound-app.com if you believe your account has been accessed without permission. You are responsible for everything that happens under your account. Usernames may contain only lowercase letters, numbers, and underscores; we may reclaim usernames that impersonate others or violate these Terms.
3. Your content
TrailBound lets you post rides, trails, photos, short video clips, condition reports, points of interest, group descriptions, and messages ("Your Content"). You keep ownership of Your Content. You grant TrailBound a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely to operate and improve the Service and to show it to the members you share it with. This license ends when you delete the content or your account, except for content that other members have already received (for example messages in a shared chat, which remain visible to those participants and are attributed to "Deleted User") and for copies kept in routine backups for a limited time.
You are responsible for Your Content. You confirm that you own it or have the rights needed to post it, and that it does not violate these Terms or anyone else's rights.
4. Community rules
TrailBound has zero tolerance for objectionable content and abusive behavior. You agree not to post or do any of the following:
- Harass, threaten, bully, or intimidate anyone, or encourage others to do so.
- Post hateful content or content that targets people based on race, ethnicity, religion, gender, sexual orientation, disability, or similar characteristics.
- Post sexually explicit content, graphic violence, or content that promotes self-harm or illegal drug use.
- Impersonate any person or organization, or misrepresent your affiliation.
- Post spam, scams, advertising, or repeated unsolicited messages.
- Share another person's private information (including their location) without their consent.
- Post content that infringes anyone's copyright, trademark, or other rights.
- Post inaccurate trail or condition information on purpose, or trails on private land or closed areas without authorization.
- Attempt to access other users' data, interfere with the Service, reverse engineer the app, or use automated tools to scrape it.
- Use the Service to plan or promote illegal riding, trespassing, or damage to land.
5. Reporting, blocking, and enforcement
Every profile, message, ride, trail, and group has a Report option, and you can block any member from their profile. Blocked members cannot message you or send you friend requests, and their content is hidden from you. We review reports within 24 hours and will remove content, suspend, or permanently ban accounts that violate these Terms, at our discretion and without prior notice. You can also report content by emailing support@trail-bound-app.com.
6. Off-road riding risks and assumption of risk
Off-road riding is inherently dangerous and can result in serious injury, death, or property damage. Trails, conditions, difficulty ratings, and meet-up points on TrailBound are contributed by users and may be inaccurate, out of date, or unsafe. You are solely responsible for deciding whether a trail or ride is appropriate for your skill level, machine, and equipment; for checking current conditions, weather, closures, and land-manager rules; for wearing appropriate safety gear; and for obeying all laws. Rides organized through TrailBound are organized by their members, not by us, and we are not responsible for what happens on them. By using the Service you knowingly and voluntarily assume all risks of off-road riding.
7. Not a navigation or safety device
TrailBound is not a navigation, emergency, or safety device. GPS positions, recorded tracks, distances, and maps may be inaccurate, delayed, or unavailable, especially in remote areas without cell coverage. Do not rely on the app to find your way or to call for help. Carry a paper map, a compass, a satellite communicator or other means of contacting emergency services, and tell someone where you are going.
8. Location and other permissions
Some features need device permissions: precise location (to show nearby content and to record rides, including while the screen is off during a recording), camera and photos (to add pictures), and notifications. You can change these permissions in your device settings at any time. How we handle this data is described in our Privacy Policy.
9. Copyright complaints
If you believe content on TrailBound infringes your copyright, send a notice to support@trail-bound-app.com that includes: your contact details; a description of the copyrighted work; the location of the content in the app (for example the username, trail name, or group); a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove infringing content and may terminate the accounts of repeat infringers.
10. Our intellectual property
The TrailBound name, logo, app, and website (excluding Your Content and other members' content) are owned by us and protected by copyright and trademark law. We grant you a limited, revocable, non-transferable license to use the app on devices you own or control for personal, non-commercial purposes in accordance with these Terms.
11. Termination
You can delete your account at any time from the Profile tab (Delete Account) or by following the steps at https://trail-bound-app.com/delete-account. We may suspend or terminate your account, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service. Sections 3, 6, 7, 12 through 15 survive termination.
12. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Service will be uninterrupted or error-free, that GPS data will be accurate, or that content posted by members is reliable.
13. Limitation of liability
To the fullest extent permitted by law, TrailBound and Josh Sharrer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, injury, death, or property damage arising from your use of the Service, participation in any ride, or reliance on any content, even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Service will not exceed fifty US dollars (USD 50) or the amount you paid us in the twelve months before the claim, whichever is greater. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless TrailBound and Josh Sharrer from any claims, damages, and expenses (including reasonable attorney fees) arising from Your Content, your use of the Service, your participation in any ride, or your violation of these Terms or of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, United States, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Nevada, and you consent to their jurisdiction. Before filing a claim, you agree to contact us at support@trail-bound-app.com and give us 30 days to try to resolve the dispute. Nothing in this section prevents either party from seeking injunctive relief or from bringing a claim in small-claims court.
16. Changes to these Terms
We may update these Terms from time to time. We will update the date above and publish the new version in the app and at https://trail-bound-app.com/terms, and we will notify you in the app of material changes before they take effect. Continued use of the Service after a change means you accept the updated Terms.
17. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If any part of these Terms is found unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them to a successor of the Service. Apple and Google are not parties to these Terms and have no responsibility for the Service; Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you for the iOS app.
